第1条（総則・目的）/ General Rules and Purpose
  • 1. 株式会社元林（住所：兵庫県神戸市東灘区本山南町8丁目6番26号東神戸センタービル (West ) 7階、代表者の氏名：村尾光一）（以下「当社」といいます。）は、当社が運営する公衆喫煙所（以下「本施設」といいます。）の会員登録および本施設の利用に際して取得する個人情報（顔画像・顔認証データを含みます。）及び個人関連情報の取り扱いについて、個人情報の保護に関する法律（以下「個人情報保護法」といいます。）その他関連法令および当社が定める規程に基づき、適切に取得・利用・管理します。
  • 1. MOTOBAYASHI Co., Ltd. (address: Higashi-Kobe Center Building (West), 7F, 8-6-26 Motoyama-minami-machi, Higashinada-ku, Kobe-shi, Hyogo; Representative: Koichi Murao) (“we,” “us,” or “our company”) runs a public smoking area (the “Facility”). When you sign up as a member and use the Facility, we handle personal information about you (including a photo of your face and face-recognition data) and information related to individuals that we collect. We collect, use, and manage this information carefully, following Japan’s Act on the Protection of Personal Information and other related laws, as well as our own internal rules.
  • 2. 本施設の利用者登録を行った方（以下「利用者」といいます。）は、本プライバシーポリシーに同意のうえ、利用者登録を完了するものとします。
  • 2. If you sign up to use the Facility (a “User”), you agree to this Privacy Policy before your sign-up is complete.


第2条（取得する個人情報又は個人関連情報の項目）/ Personal Information and Related Information We Collect

当社は、以下の個人情報又は個人関連情報を取得します。We collect the following personal information and information related to individuals (this means information that is not, by itself, personal information about a specific person, but could become personal information if combined with other data — for example, some website browsing data).

第3条（個人情報の利用目的）/ Why We Use Your Personal Information

当社は、取得した個人情報を以下の目的で利用します。

  • 利用者登録および本人確認
  • 利用者が20歳以上であることの年齢確認（法令上の義務）
  • 顔認証による本施設への入退室管理
  • 本施設への不正入場・不正認証の防止および不正利用への対応
  • 本施設の防犯・安全管理および本施設内での事故・トラブルへの対応
  • 本施設の運営・管理・改善のための、本施設の利用状況の分析
  • 利用者への重要なお知らせ・本施設からの通知の送信
  • Briquet Online（ブリケオンライン）の会員サービスの提供（本施設の利用者登録と同時にBriquet Onlineの会員として登録されます。詳細は第4条をご参照ください。）及び同サービスに関する情報の提供、広告又は宣伝
  • 法令に基づく対応および行政機関からの照会への回答
  • その他上記に付随・関連する業務の遂行

We use the personal information we collect for the following purposes:

  • To register you as a User and confirm your identity
  • To confirm that the User is 20 years of age or older (this is required by law)
  • To manage entry to and exit from the Facility using face recognition
  • To prevent unauthorized entry to the Facility or misuse of face recognition, and to respond to such misuse
  • For crime prevention and safety management at the Facility, and to deal with accidents or problems inside the Facility
  • To analyze how the Facility is used, in order to run, manage, and improve the Facility
  • To send Users important notices and messages from the Facility
  • To provide Briquet Online membership services (when you register to use the Facility, you are automatically also registered as a Briquet Online member — see Article 4 for details), and to provide information about, or advertise and promote, that service
  • To respond to legal requirements and to answer questions from government authorities
  • For other tasks related to the purposes above


第4条（Briquet Online会員登録との関係）/ Relationship with Briquet Online Membership
  • 本施設の利用者登録を行った方は、登録と同時に自動的にBriquet Online（ブリケオンライン）の会員として登録されます。
  • Briquet Online会員として登録されることにより、Briquet Onlineが提供するサービス（オンラインショッピング、会員向け特典、キャンペーン情報の受信等）をご利用いただくことができます。
  • Briquet Onlineにおける個人情報の取扱いについては、Briquet Onlineプライバシーポリシーも併せて適用されます。
  • Briquet Online会員としての登録に関するお問い合わせ・退会希望については、当社所定の手続きにより対応いたします。

  • If you register to use the Facility, you are automatically also registered as a Briquet Online member.
  • As a Briquet Online member, you can use the services Briquet Online offers, such as online shopping, member benefits, and campaign information.
  • The Briquet Online Privacy Policy also applies to how your personal information is handled as a Briquet Online member.
  • If you have questions about your Briquet Online membership, or want to cancel it, please contact us using our standard procedure.


第5条（顔画像・顔認証データの取扱いに関する特則）/ Special Rules for Face Photos and Face-Recognition Data
  • 顔画像および顔認証データは、センシティブな個人情報として、特に厳重に管理します。
  • 顔画像および顔認証データは、第3条に定める利用目的（入退室管理・年齢確認・不正利用防止等）の範囲内においてのみ利用し、それ以外の目的には利用しません。
  • 顔認証データは、以下の場合に削除します。
    • 利用者から削除の申請があった場合（利用者登録取消時を含みます。）
    • 法令に基づき保存が必要な期間を経過した場合
    • 当社が定める保存期間が経過した場合
  • 利用者は、顔認証データの取扱いについて、いつでも当社に対して照会・削除の申請を行うことができます。

  • We treat face photos and face-recognition data as sensitive personal information, and we manage them with extra caution.
  • We use face photos and face-recognition data only for the purposes listed in Article 3 (such as managing entry and exit, confirming age, and preventing misuse). We do not use them for any other purpose.
  • We delete face-recognition data in the following cases:
    • When a User asks us to delete it (including when a User cancels their registration)
    • When the period required by law for keeping the data has ended
    • When the period we have set for keeping the data has ended
  • Users may contact us at any time to ask about, or request the deletion of, their face-recognition data.


第6条（個人情報の第三者提供）/ Sharing Personal Information with Third Parties

当社は、以下の場合を除き、利用者の個人情報を第三者に提供しません。

  • 利用者ご本人の同意がある場合
  • 法令に基づく場合（警察・行政機関等からの適法な照会等）
  • 人の生命・身体・財産の保護のために必要な場合であって、ご本人の同意を得ることが困難な場合
  • 業務委託先への提供（第7条参照）
  • 決済代行会社・クレジットカード会社等への提供（決済サービスおよびこれに付随するサービス〔本人確認・与信調査・不正利用防止等〕の提供に必要な範囲）

We do not share Users’ personal information with third parties, except in the following cases:

  • When the User has given consent
  • When required by law (for example, a lawful request from the police or a government authority)
  • When necessary to protect a person’s life, body, or property, and it is difficult to get the User’s consent first
  • When we share information with a company we have hired to handle certain tasks for us (see Article 7)
  • When we share information with a payment-processing company or credit card company (only as far as necessary to provide payment services and related services, such as identity checks, credit checks, and preventing misuse)


第7条（業務委託）/ Outsourcing

当社は、第3条に定める利用目的の達成に必要な範囲で、個人情報の全部又は一部の取扱いを第三者に委託することがあります。この場合、当社は当該委託先と必要な契約を締結し、必要かつ適切な監督を行います。
We may outsource all or part of the handling of personal information to a third party, as far as necessary to achieve the purposes listed in Article 3. When we do this, we sign a necessary contract with that company and provide necessary and appropriate supervision.



第8条（Cookieおよびアクセス解析ツールの利用）/ Use of Cookies and Access-Analysis Tools
  • 1. Cookieについて
    当社の登録ページおよびウェブサイトでは、Cookieを使用する場合があります。Cookieは、利用者の端末に保存される小さなデータファイルであり、利用者のウェブサイト利用状況の把握・利便性向上のために利用します。ブラウザの設定によりCookieを無効にすることは可能ですが、一部機能が利用できなくなる場合があります。

    Our sign-up page and website may use cookies. A cookie is a small data file saved on your device. We use cookies to understand how Users use our website and to make it easier to use. You can turn off cookies in your browser settings, but some features may stop working if you do.
  • 2. Google アナリティクス4（GA4）について
    当社は、登録ページおよびウェブサイトのアクセス解析のため、Google LLC が提供するGoogle アナリティクス4（GA4）を利用しています。
    GA4は、Cookieおよびこれに類する技術を通じて、以下の情報を収集します。
    • ページの閲覧状況・滞在時間
    • 流入経路（検索・SNS・広告等）
    • 使用端末・ブラウザの種類
    • 地域情報（国・都道府県レベル）
    収集された情報はGoogleのサーバーに送信・保存されます。GA4によるデータの収集・処理については、Googleのプライバシーポリシーをご参照ください。
    また、利用者はGoogleが提供するGoogleアナリティクス オプトアウトアドオンを使用することにより、GA4によるデータ収集を無効化することができます。
  • 2. About Google Analytics 4 (GA4)
    We use Google Analytics 4 (GA4), a service from Google LLC, to study how people access our sign-up page and website.
    GA4 collects the following information through cookies and similar technology:
    • Pages viewed and time spent on the site
    • How you arrived at the site (search engine, social media, advertisement, etc.)
    • Type of device and browser used
    • - Location information (country, and state/prefecture level)
    The information collected is sent to and stored on Google’s servers. For details on how Google collects and processes this data, please see Google’s Privacy Policy: https://policies.google.com/privacy
    Users can also stop GA4 from collecting their data by using the Google Analytics Opt-out Browser Add-on, provided by Google: https://tools.google.com/dlpage/gaoptout


第9条（個人情報の管理・安全管理措置）/ Managing Personal Information and Security Measures

当社は、取得した個人情報の紛失・破壊・改ざん・漏洩・不正アクセス等を防止するため、以下を含む必要かつ適切な安全管理措置を講じます。当社が講じる安全管理措置の具体的な内容については、本プライバシーポリシー第12条に記載の当社問合せ窓口にお問い合わせください。

  • 個人情報保護に関する社内規程の整備および従業員への教育・徹底
  • 個人情報管理責任者の設置
  • アクセス権限の制限および管理
  • データの暗号化・システムへのセキュリティ対策
  • 委託先に対する適切な監督

To prevent the loss, damage, tampering, leaking, or unauthorized access of personal information we collect, we take necessary and appropriate security measures, including:

  • Setting internal rules for protecting personal information, and training employees on these rules
  • Appointing a person responsible for managing personal information
  • Limiting and controlling who can access the data
  • Encrypting data and taking security measures for our systems
  • Properly supervising any company we outsource work to

第10条（利用者の権利）/ Users’ Rights

利用者は、当社が保有する利用者自己の個人情報について、以下の権利を行使することができます。

  • 個人データ開示の請求
  • 個人データの訂正・追加・削除の請求
  • 個人データの利用停止・消去の請求
  • 個人データの第三者提供の停止の請求
  • 顔認証データの削除の申請

上記のご請求は、本プライバシーポリシー第12条記載のお問い合わせ窓口にご連絡ください。当社は、ご本人確認のうえ、法令に定める期間内に対応いたします。但し、法令上上記の請求に応じないことができるとされる場合には、ご要望にお応えできない場合もございます。


Users may exercise the following rights regarding their own personal information that we hold:

  • Request to disclose personal data
  • Request to correct, add to, or delete personal data
  • Request to stop using, or to erase, personal data
  • Request to stop sharing personal data with third parties
  • Request to delete face-recognition data

To make any of the requests above, please contact us at the contact point listed in Article 12 of this Privacy Policy. We will confirm your identity and respond within the period required by law. However, in cases where the law allows us not to respond to such a request, we may not be able to do what you ask.



第11条（プライバシーポリシーの変更）/ Changes to This Privacy Policy

当社は、法令改正・事業内容の変更・その他合理的な事由がある場合、本プライバシーポリシーを変更することがあります。変更後のプライバシーポリシーは、当社ウェブサイトへの掲載その他当社が適当と認める方法により通知した時点または当社が別途定める日から効力を生じます。なお、個人情報が収集された時点で同意を得た内容を超えて個人情報を利用する場合は、改めて同意の確認をいたします。
We may change this Privacy Policy if there is a change in the law, a change in our business, or another reasonable reason. The revised Privacy Policy takes effect when we post it on our website, tell you about it in another way we think is appropriate, or on a date we set separately. If we plan to use your personal information for a new purpose that goes beyond what you originally agreed to, we will ask for your consent again.
