• 本規約は、当社が運営する公衆喫煙所（以下「本施設」といいます。）の利用条件を定め、利用者の安全確保、周辺環境への配慮、秩序維持および適正な施設運営を図ることを目的とします。
  These Terms of Use ("Terms") set out the conditions for using the public smoking area ("Facility") operated by our company. Their purpose is to ensure the safety of users, show consideration for the surrounding environment, maintain order, and support proper facility management.
• 本規約が適用される本施設は、以下のとおりとします。
  The Facility to which these Terms apply is as follows.
  (1) 第１号店（住所：神戸市中央区北長狭通１丁目30（東海道本線　三宮～元町駅間高架下浜31号一部）） Store No. 1 (Address: 1-30 Kitanagasa-dori, Chuo-ku, Kobe City (part of Hama No. 31 under the elevated railway section between Sannomiya and Motomachi Stations on the Tokaido Main Line))

• 本施設を利用するすべての方（以下「利用者」といいます。）は、本規約に同意のうえ、本施設を利用するものとします。
  All persons using the Facility ("Users") must agree to these Terms before using the Facility.
• 当社は、本規約のほか、本施設内の掲示、案内表示、注意事項、利用者登録画面上の表示その他個別ルールを定めることができ、利用者は、これらの本規約のみならず、個別ルールにもしたがって、本施設を利用するものとします。
  In addition to these Terms, our company may establish individual rules through notices posted inside the Facility, signage, cautionary statements, registration screen displays, and other means. Users must comply with both these Terms and any such individual rules.
• 本規約と個別ルールの内容が異なる場合は、個別ルールが優先して適用されます。
  Where individual rules conflict with these Terms, the individual rules shall take precedence.

• 本施設は、公衆の利用に供する、利用料無料の喫煙所です。
  The Facility is a smoking area open to the public and free of charge.
• 本施設は、完全無人運営であり、常駐スタッフによる受付、本人確認、案内、監視または即時対応は行いません。
  The Facility is fully unattended. There are no on-site staff for reception, identity verification, guidance, monitoring, or immediate response.
• 利用者は、自己の責任において本施設を利用するものとします。
  Users use the Facility at their own responsibility.

• 本施設を利用できるのは、20歳以上の方に限ります。
  Use of the Facility is restricted to persons aged 20 or older.
• 20歳未満の方は、本施設を利用することはできません。
  Persons under the age of 20 may not use the Facility.
• 妊娠中の方は、本施設を利用することはできません。
  Pregnant persons may not use the Facility.
• 利用者は、当社所定の方法により本施設の利用者登録を行い、利用者が20歳以上であることの確認に必要な情報を、真実かつ正確に登録しなければなりません。
  Users must complete user registration using the method designated by our company and must provide accurate and truthful information confirming that they are 20 years of age or older.
• 前項の登録に際して、利用者が虚偽の情報を登録した場合、当社は、本施設の利用者登録を取り消し、本施設の以後の利用を禁止することができます。
  If a User provides false information during registration, our company may cancel the User's registration and prohibit further use of the Facility.

• 本施設の利用には、利用者自身のスマートフォン等を用いた利用者登録が必要です。
  Use of the Facility requires user registration via the User's own smartphone or similar device.
• 利用者は、当社または当社が指定するシステム上で、氏名、生年月日、連絡先その他当社所定の情報ならびに自己の顔画像その他顔認証に必要な情報を登録するものとします。
  Users must register their name, date of birth, contact information, and other information required by our company, as well as their facial image and any other data necessary for facial recognition, through a system designated by our company.
• 利用者は、登録した顔情報を用いて、本施設入口に設置されたカメラによる顔認証を受け、認証が完了した場合に限り入場できるものとします。
  Users must complete facial recognition via the camera installed at the Facility entrance using their registered facial data. Entry is permitted only upon successful authentication.
• 顔認証の精度、通信状況、機器不具合その他の事情により利用者を認証できず、利用者が本施設を利用できない場合であっても、当社は、利用者の本施設への入場または利用継続を保証しません。
  Our company does not guarantee entry or continued use of the Facility if authentication fails due to issues with recognition accuracy, network connectivity, equipment malfunction, or other circumstances.
• 利用者は、自己以外の第三者に自己の利用者登録上の地位を利用させてはなりません。
  Users must not allow any third party to use their registration status.
• 利用者は、利用者登録に際して、第三者の顔画像、登録情報その他第三者に関する情報を不正に使用してはなりません。
  Users must not unlawfully use another person's facial image, registration information, or other personal data during registration.

• 当社は、利用者登録、年齢確認、入退室管理、不正利用防止、防犯、安全管理、トラブル対応、法令対応その他当社が別途当社プライバシーポリシーにて定める目的のため、利用者の登録情報、顔画像、顔認証データ、入退室履歴その他必要な情報を取得し、利用します。
  Our company collects and uses Users' registration information, facial images, facial recognition data, entry/exit records, and other necessary information for the purposes of user registration, age verification, entry/exit management, fraud prevention, security, safety management, incident response, regulatory compliance, and other purposes set out in our Privacy Policy.
• 利用者は、前項の利用目的の範囲内で、当社が当該情報を取り扱うことに同意するものとし、本施設の利用者登録を行うものとします。
  Users consent to our company handling such information within the scope of the purposes described above, and complete user registration accordingly.
• 当社は、顔画像および顔認証データの取扱いについて、法令および当社プライバシーポリシーに従い適切に管理します。
  Our company manages facial images and facial recognition data appropriately in accordance with applicable laws and our Privacy Policy.
• 利用者は、本施設の利用開始前に、当社が別途定める当社プライバシーポリシーその他個人情報の取扱いに関する表示を確認し、同意するものとします。
  Before beginning to use the Facility, Users must review and consent to our Privacy Policy and any other notices relating to the handling of personal information.

• 本施設の営業時間は、開店時刻を7時00分とし、閉店時刻を22時00分までとします。 The Facility is open from 7:00 AM to 10:00 PM.
• 利用者は、営業時間内に限り本施設を利用できるものとし、22時00分までに退出しなければなりません。 Users may only use the Facility during opening hours and must exit by 10:00 PM.
• 本施設の出入口は、22時10分に自動施錠されます。 The Facility entrance/exit door is automatically locked at 10:10 PM.
• 利用者は、閉店時刻までに自己の責任において速やかに退出するものとします。 Users are responsible for exiting promptly before closing time.
• 当社は、安全管理、設備点検、災害、行政指導その他必要がある場合、営業時間内であっても本施設の入場制限、利用停止または一時閉鎖を行うことができます。 Our company may restrict entry, suspend operations, or temporarily close the Facility at any time during opening hours for reasons including safety management, equipment inspection, natural disasters, or regulatory guidance.

利用者は、本施設の利用にあたり、次の各号の行為をしてはなりません。
Users must not engage in any of the following activities:

• 20歳未満の者を本施設に入場させ、または入場を試みさせる行為
  Allowing or attempting to allow any person under the age of 20 to enter the Facility.
• 妊娠中の者を本施設に入場させ、または入場を試みさせる行為
  Allowing or attempting to allow any pregnant person to enter the Facility.
• 第三者になりすます行為、第三者の顔情報を用いて利用者登録を行う行為・第三者の登録情報を用いて本施設を利用する行為
  Impersonating another person, registering using another person's facial image, or using another person's registration data to access the Facility.
• 利用者登録上の地位、認証権限その他本施設の利用上の地位を第三者に貸与、譲渡、共有または承継させる行為
  Lending, transferring, sharing, or assigning one's registration status, authentication rights, or any other access rights to a third party.
• 指定場所以外での喫煙、吸い殻・灰・ごみの放置
  Smoking outside the designated area, or leaving cigarette butts, ash, or trash.
• 当社が別途認める場合を除き、飲食物を本施設内に持ち込む行為
  Bringing food or beverages into the Facility, except where expressly permitted by our company.
• 長時間の占有、居座り、寝泊まり、食事その他本来の喫煙目的を逸脱する行為
  Occupying the Facility for extended periods, loitering, sleeping, eating, or otherwise using it for purposes other than smoking.
• 大声での会話、長時間の通話その他他の利用者または近隣に迷惑を及ぼす行為
  Causing a nuisance to other Users or neighbours through loud conversation, prolonged phone calls, or similar behaviour.
• 火災、爆発、異臭その他の危険を生じさせるおそれのある行為（喫煙をするために通常必要と認められる範囲内の行為を除く）
  Creating a risk of fire, explosion, unusual odours, or other hazards (except for actions ordinarily necessary for smoking).
• 本施設の設備、扉、カメラ、認証機器、換気設備、灰皿その他備品の汚損、破損、持出しまたは妨害
  Soiling, damaging, removing, or interfering with the Facility's equipment, doors, cameras, authentication devices, ventilation systems, ashtrays, or other fixtures.
• 泥酔状態での利用、薬物使用下での利用、暴力、脅迫、威圧、ハラスメントその他これらに類する行為
  Using the Facility while heavily intoxicated or under the influence of drugs, or engaging in violence, threats, intimidation, harassment, or similar behaviour.
• 本施設の利用者への営業活動、勧誘、宣伝、資料の配布、本施設内での撮影、録音、配信行為その他当社が承認していない行為
  Conducting sales activities, solicitation, advertising, leaflet distribution, photography, audio recording, live streaming, or any other activity not approved by our company.
• 法令、公序良俗または本規約に違反する行為
  Violating any applicable laws or regulations, public order and morals, or these Terms.
• その他、当社が不適切と判断する行為
  Any other activity deemed inappropriate by our company.

• 利用者は、本施設内の掲示、案内表示および設備の使用方法に従い、本施設を利用するものとします。
  Users must follow all notices, signage, and equipment usage instructions posted inside the Facility.
• 利用者は、吸い殻、灰その他当社所定の方法で処理すべきものを除き、自己が持ち込んだごみを各自で持ち帰るものとします。
  Except for cigarette butts, ash, and other items to be disposed of by methods designated by our company, Users must take their own rubbish with them when they leave.
• 利用者は、吸い殻、灰等を当社指定の方法で処理し、本施設の清潔保持に協力するものとします。
  Users must dispose of cigarette butts, ash, and similar waste using the methods designated by our company and cooperate in keeping the Facility clean.
• 利用者は、本施設内の秩序維持、衛生保持および受動喫煙対策に協力するものとします。
  Users must cooperate in maintaining order and hygiene and in measures to prevent secondhand smoke exposure.
• 利用者は、自身の体調、健康状態および周囲の安全に十分配慮して利用するものとします。
  Users must pay due attention to their own physical condition, health, and the safety of those around them.

• 利用者は、本施設内の設備、備品、扉、認証機器、換気設備その他一切の設備を適切に使用するものとします。
  Users must use all equipment, fixtures, doors, authentication devices, ventilation systems, and other facilities properly.
• 利用者が本施設内の設備、備品等を汚損、破損または紛失した場合、当社は、修理費、交換費、清掃費その他必要な費用を請求できるものとします。
  If a User soils, damages, or loses any equipment or fixture, our company may charge the User for repair, replacement, cleaning, and other necessary costs.
• 利用者は、設備の異常、破損、故障その他事故につながるおそれを発見した場合、速やかに当社所定の連絡先へ連絡するものとします。
  If a User discovers any abnormality, damage, malfunction, or other condition that could lead to an accident, they must promptly notify our company using the designated contact method.

当社は、利用者が次の各号のいずれかに該当すると判断した場合、事前通知なく、本施設の利用停止、入場拒否、利用者登録の取消その他必要な措置を講じることができます。
Our company may, without prior notice, suspend a User's access, refuse entry, cancel a User's registration, or take other necessary action if any of the following applies:

• 本規約に違反した場合
  The User has violated these Terms.
• 利用者登録の登録情報に虚偽、誤記または不備があった場合
  The User's registration information contains false statements, errors, or omissions.
• 利用者が20歳未満であることが判明した場合
  The User is found to be under the age of 20.
• 利用者が妊娠中であることが判明した場合
  The User is found to be pregnant.
• 不正入場、不正認証またはこれらのおそれがある場合
  Unauthorised entry or authentication has occurred or is suspected.
• 本施設の運営を妨げる行為があった場合
  The User has engaged in conduct that interferes with the operation of the Facility.
• 反社会的勢力またはその関係者であることが判明した場合
  The User is found to be a member of, or associated with, an antisocial organisation.
• その他、当社が本施設の利用を不適当と判断した場合
  Our company otherwise determines that the User's continued use of the Facility is inappropriate.

• 当社は、当社の責めに帰すべき事由（当社に故意または重過失がある場合を除きます。）により、利用者間または利用者と第三者との間に生じたトラブル、盗難、紛失、傷害、健康被害その他の事故が発生し、利用者に損害が生じた場合、利用者に直接かつ現実に生じた損害を限度として責任を負います。
  Where our company bears responsibility (excluding cases of our intentional misconduct or gross negligence), our liability for disputes, theft, loss, injury, health damage, or other incidents that directly and actually harm a User shall be limited to the direct and actual loss suffered by the User.
• 当社は、顔認証システムの不具合、誤認識、認証遅延または利用者の端末・通信環境に起因する利用者への不利益について、当社の責めに帰すべき事由（当社に故意または重過失がある場合を除きます。）によるものである場合、利用者に生じた損害は、直接かつ現実に生じた損害を限度として、責任を負います。
  Where our company bears responsibility (excluding cases of our intentional misconduct or gross negligence) for disadvantage caused by facial recognition system malfunctions, misidentification, authentication delays, or issues with a User's device or network, our liability shall be limited to the direct and actual loss suffered by the User.
• 当社は、営業時間終了までに退出しなかったことにより利用者に生じた損害について、当社の責めに帰すべき事由（当社に故意または重過失がある場合を除きます）がある場合、利用者に生じた損害は、直接かつ現実に生じた損害を限度として、責任を負います。
  Where our company bears responsibility (excluding cases of our intentional misconduct or gross negligence) for damage suffered by a User as a result of failing to exit before closing time, our liability shall be limited to the direct and actual loss suffered by the User.
